About pool fencing and barrier safety standards

The NT government has strict safety regulations for residential pools and spas, including a requirement that any pool or spa must have a barrier. The types of barriers depend on the size but often include fences or moats to prevent access from children who are not supervised by an adult.

The Northern Territory (NT) is home to many harsh natural elements such as extreme weather conditions which make it necessary for all homes with pools in their backyards to be equipped with either fencing around them-particularly if they’re private property where there’s no supervision at all times-, moats so small children can’t get out without assistance, locks preventing anyone who isn’t authorized from gaining entry into the backyard area etcetera; all of these measures help ensure your family’s safety.

Different standards and certification requirements apply depending on:

  • if your pool was installed before or after 1 January 2003
  • and if the property has previously been sold, transferred or leased.

The laws and regulations for pool safety barriers in the NT are in the Swimming Pool Safety Act 2004

The standards on this page apply to residential properties including:

  • houses
  • units
  • townhouses
  • caravans and mobile homes in a caravan park.

The rules and standards are not compulsory for residential properties greater than 1.8 hectares, but you can choose to get certification for a pool safety barrier if your property falls into this category. You should fence your pool or spa even if you do not want it certified just in case someone trespasses onto the premises without warning.

There are two pool safety barrier standards in the Northern Territory (NT):

  • Modified Australian Standard
  • Community Safety Standard.

The Modified Australian Standard is the higher standard. In cases where compliance to both safety standards might seem impossible or burdensome it is always better to look for alternatives that could provide a safe design as opposed to falling back on dangerous practices such as improvisation.

The NT swimming pool safety laws and regulations reference the following Australian Standards:

  • AS 1926.1 – 1993 Swimming Pool Safety Part 1: Fencing for swimming pools
  • AS 1926.2 – 1995 Swimming Pool Safety Part 2: Location of fencing for private swimming pools.

The Modified Australian Standard is a modification of these standards.

The modifications relate to:

  • requirements if chain mesh fencing is used
  • and measuring the height of the fence from inside your property, instead of from your neighbour’s property, if a common fence is part of the pool safety barrier.

The modified Australian standard is a set of detailed rules and measurements that dictate how pool safety barriers must be installed in order to restrict accesses by unsupervised children under five years old.

The Community Safety Standard requires that a pool safety barrier must be designed, sited, installed and maintained so the barrier will prevent unsupervised children under five years of age from entering your pool area.

The Community Safety Standard can only be applied to some pools ;installed before 1 January 2003.

In some situations, your pool safety barrier may not be able to meet the requirements of the Modified Australian Standard or Community Safety Standards. Non-standard barriers are allowed in these cases and they still must comply with regulations requiring them to restrict access for children under five years old.

The non-standard safety provision can only be used if the owner is aware of the risks posed to a child by the swimming pool. This means that, even though there are no physical barriers separating children from potential hazards like chlorine and other chemicals in pools, they will still be protected with this additional measure as long as their parents have been made aware of how dangerous these elements may potentially be for them.

The situations where the non-standard safety provision can be applied are:

  • where the land or buildings or the design of the pool make it difficult and it would not be reasonable to require the pool safety barrier to comply with the standard requirement
  • on a small property with an area less than 300 square metres
  • on a property with water frontage like a beachfront, river or marina
  • a spa pool on the balcony of an apartment where self-closing and self-latching doors and windows restrict access
  • a spa pool with a lockable lid or cover.
